SPOSF: Contact Senators to say - NO ON SB 364! DON'T TAMPER WITH THE ELLIS ACT!

Last year we defeated SB 1439, the bill authored by Senator Mark Leno to alter the Ellis Act to allow San Francisco to prohibit the resale of properties for five years. Again this year, Senator Leno has introduced SB 364 to do the same thing but to exclude certain small properties, but not all of them. 
Following is a list of the California State Senators who are considering this measure, along with their office phone numbers and a website for contacting the Senators through email.
If calling simply state your name and that you are in opposition to SB 364 as the staff compiles a tally of callers and their positions. Below are a list of points for email writers;

  • Rental property owners may no longer be able to sell property even if they are losing money every month. The legislation allows for an exemption of 4 units or less if the property is owned by a Natural Person. However LLC's and Trusts are not exempt.
  • There is no other industry in the United States where a local government can force a small business owner to stay in business against his or her will, even when losing money.
  • SB 364 would prevent families who own small rental buildings from creating a home that meets their needs. Couples with young children often find themselves in need of additional space.
  • There is already fair and reasonable compensation to displaced tenantsCurrently San Francisco requires a relocation assistance to displaced tenants of - $5,555 for each tenant when the owner wishes to take the units off the market.
  • SB 364 will not provide additional housing.
  • By limiting the ability of owners and buyers to sell or convert their properties, investments in housing will be discouraged. SB 364 will kill housing.
  • Fewer than 160 units were affected by the Ellis Act last year; the Ellis "crisis" has been created by the tenants' lobby.
